its judicial precedent btw

Answers

Answer 1

The ratio decidendi, or the legal reasoning behind a court decision, can be difficult to establish for various reasons.

Write an example from civil or criminal law to illustrate ratio decidendi?Multiple factors contributing to the decision: Court decisions can be influenced by a variety of factors, including legal precedent, statutory interpretation, and the specific facts of the case. As a result, determining the precise legal reasoning behind a court's decision can be challenging.Conflicting opinions among judges: In some cases, judges may disagree on the legal reasoning behind a decision, which can make it difficult to establish a clear ratio decidendi.

For example, in the case of R v. Dudley and Stephens (1884), two men were charged with murder after killing a young cabin boy in order to survive at sea. The court ultimately found the men guilty of murder, but the ratio decidendi of the case has been the subject of much debate.

One reason why the ratio decidendi of the case may be difficult to establish is the complex legal and ethical issues involved. The court had to balance the principles of self-defense and necessity against the value of human life, and there were differing opinions among the judges regarding the legal reasoning behind the decision.

What is the sample of the advocacy presentation on pollution?

Good afternoon, everyone. I am here to talk to you about one of the most pressing issues facing our planet today: pollution. Pollution is a serious problem that affects us all, from the air we breathe to the water we drink. It's time for us to take action and make a change.

First, let's talk about the impact of pollution on our health. Pollution in the air can lead to respiratory problems, heart disease, and even cancer. In fact, the World Health Organization estimates that air pollution is responsible for 7 million premature deaths each year. And it's not just the air we need to worry about. Pollution in our water supply can lead to illnesses, such as cholera and dysentery.

Pollution also has a devastating effect on our planet's ecosystems. When we dump toxic waste into our rivers and oceans, we are destroying the habitats of countless animals. When we release greenhouse gases into the atmosphere, we are contributing to global warming, which is leading to rising sea levels, more severe weather patterns, and the extinction of species.

So, what can we do to reduce pollution? There are many things we can do as individuals and as a society. We can start by reducing our reliance on single-use plastics, such as straws and plastic bags. We can also conserve energy by turning off lights and electronics when we're not using them. We can use public transportation, walk, or bike instead of driving alone in a car. Additionally, we can support clean energy sources like wind and solar power.

But individual actions are not enough. We need our government to take action as well. We can demand that our elected officials pass laws that limit pollution and support clean energy. We can also hold corporations accountable for their environmental impact and push for them to implement sustainable practices.

In conclusion, pollution is a serious problem that affects us all, and it's time for us to take action. We need to make changes in our daily lives and push for our governments and corporations to take responsibility for their impact on the environment. Let's work together to create a healthier and more sustainable planet for ourselves and future generations. Thank you.

what are six sentencing choices that many state judges have?

Answers

Answer:

State judges in the United States have a range of sentencing choices available to them, which can vary based on the specific laws and guidelines of each state. While the exact options may differ, here are six common sentencing choices that many state judges have:

Incarceration: Judges can choose to impose a prison sentence, where the convicted individual is confined in a correctional facility for a specific period. The length of the sentence can vary based on the severity of the crime and other factors.

Probation: Instead of incarceration, judges may opt for probation, which allows the convicted individual to remain in the community under specific conditions. These conditions typically include regular check-ins with a probation officer, adherence to certain rules, and completion of any mandated programs or community service.

Fines: Judges can impose monetary fines as part of the sentence. The amount of the fine can vary depending on the offence and the financial situation of the convicted individual. Fines serve as a form of punishment and may also be used to compensate victims or cover court costs.

Restitution: In cases where the victim has suffered financial losses or damages, judges may order the convicted individual to pay restitution. This involves reimbursing the victim for medical expenses, property damage, or other financial losses resulting from the crime.

Community Service: Judges can order community service as part of the sentence, requiring the convicted individual to perform unpaid work for a specified number of hours within the community. Community service aims to provide a form of punishment, promote rehabilitation, and contribute to the community in a positive way.

Suspended Sentence: In certain cases, judges may choose to suspend the imposition of a sentence. This means that the convicted individual is not immediately incarcerated or subjected to other penalties. However, the judge may set specific conditions that the individual must meet, such as regular check-ins, completion of counselling or rehabilitation programs, or maintaining good behaviour. Failure to meet these conditions may result in the activation of the original sentence.

It's important to note that sentencing choices can vary among states and are influenced by factors such as the nature of the crime, criminal history, and the discretion of the judge within the bounds of applicable laws and sentencing guidelines.

Then write about what I learned at least 2 pages. 1 page of talk about and describe your civic action plan ? And reflection one page how did this made you feel? (Homelessness)

Answers

Topic: Homelessness

Homelessness is a significant social issue that has been prevalent in many countries, including the United States. It is a complex issue that affects individuals, families, and communities. Homelessness occurs when people lack a fixed, regular, and adequate nighttime residence. The reasons for homelessness are varied and include poverty, mental illness, substance abuse, lack of affordable housing, and domestic violence.

Topic question: What are the causes and consequences of homelessness, and how can we address this issue effectively?

Position: Pro.

Homelessness is a serious issue that needs to be addressed, and I support efforts to find solutions to this problem. Everyone deserves a safe and stable place to call home, and it is our responsibility as a society to ensure that this basic need is met.

Research process:

Step 1: Define the research question and gather background information on the topic. This step involves identifying the key terms related to the topic and using them to search for relevant sources of information, including academic journals, government reports, and news articles.

Step 2: Develop a research strategy. This step involves identifying the research methods that will be used to collect and analyze data, including surveys, interviews, and statistical analysis.

Step 3: Collect data. This step involves gathering information from various sources, including primary and secondary data sources.

Step 4: Analyze data. This step involves using statistical methods to analyze the data and identify patterns, trends, and relationships between variables.

Step 5: Develop recommendations. This step involves using the findings from the analysis to develop recommendations for addressing the issue of homelessness.

What I learned:

Through my research, I learned that homelessness is a complex issue that is caused by multiple factors, including poverty, unemployment, lack of affordable housing, and mental health problems. I also learned that homelessness has significant consequences for individuals, families, and communities, including health problems, decreased life expectancy, and increased crime rates.

I discovered that various programs and policies have been implemented to address homelessness, including affordable housing programs, job training, and mental health services. However, more needs to be done to address this issue effectively, including increasing funding for affordable housing and social services, providing education and job training programs, and creating more affordable healthcare options for those experiencing homelessness.

Civic action plan:

As a proponent of addressing homelessness, my civic action plan would involve advocating for policies and programs that promote affordable housing, increase funding for social services, and provide education and job training opportunities for those experiencing homelessness. I would also support community-based organizations that work to address homelessness and volunteer my time and resources to support these efforts.

Reflection:

Researching the issue of homelessness has made me realize the complexity of this issue and the need for comprehensive and multifaceted solutions. It has also made me more aware of the challenges faced by those experiencing homelessness and the significant impact that this issue has on individuals, families, and communities. Overall, my research has reinforced my commitment to addressing this issue and advocating for solutions that promote affordable housing, social services, and education and job training opportunities for those experiencing homelessness.

Claire was first assigned to this case after an upscale jeweler opened his shop one morning to find several display cases empty. Distraught, he phoned police. After Claire arrived, she ordered techs to look for fingerprints and video surveillance footage. She had the owner list the stolen items so that if the thief tried to sell them nearby, police would be on the lookout.

Here is the list of stolen items the owner made, along with the value of items stolen:

TABLE 1 Stolen Item List

3-carat diamond engagement ring

$25,560

5

Mother of pearl necklace

$69,000

2

Men’s gold watch

$25,850

Unfortunately, the smart thief wore gloves, so no fingerprints were recovered from the scene. They also wore a black balaclava to cover their face, so Claire had almost no data about the thief’s appearance to work with.

Math Problem #1
Copy the table above to your math paper and calculate the total value of items lost in the first jewelry heist.

Over the following year, there were six more heists throughout the city, with total goods stolen valued at $3.75 million. Each time, the thief left no fingerprints and always wore a mask to hide their identity. The last heist did uncover one valuable clue though. As the suspect was filmed loading the jewelry into a black duffel bag, Claire caught a glimpse of a label. When she had the tech team focus in on the bag’s label, Claire found that it was the bag from an expensive French designer.

This clue led Claire to believe that the suspect must be someone who traveled internationally, particularly to France. She reached out to James, a contact in the Foreign Service sector, who was able to verify that French and British authorities had been investigating similar crimes in their countries. James was able to forward their police reports, including this list of the value of items stolen:

Math Problem #2
On your math paper, calculate the total amount of goods stolen in France and England in US dollars. Then add the total to the money stolen in Claire’s cases to find the thief’s total haul.

Good news! The authorities in France and England have made some progress: they’ve been able to coordinate the robberies with passport stamps from an American flying into and out of their country. James forwarded the name on the passport and Claire was able to run it through the system in her own police precinct. The only record that popped up was one from Ocean Recovery, a mental health facility right there in New York City.

Claire went to visit Alannah, the director of admissions at Ocean Recovery. Alannah explained to Claire that she could not divulge information about the suspect’s treatment while under their care. She could, however, confirm the dates of care. Perhaps comparing the dates that the suspect was in the care facility with the dates of the thefts would be helpful. Alannah provided Claire the following calendar:

Math Problem #3
Draw a timeline on your math sheet showing the dates that the suspect was in Ocean Recovery Center and the dates of the jewelry robberies.

Claire is convinced that she has the right suspect. To investigate any further, Claire is going to need warrants, or documents issued by a legal official authorizing the police to make an arrest, search premises, or carry out some other action relating to the administration of justice. A judge has to issue these warrants after being approached by the district attorney with enough evidence to show that they are necessary. This is where you come in.

Using a word processing document, write up Claire’s police report. List all the information that Claire has discovered, including the follow elements:

Total value of items stolen (answer to Math Problem #2)
Timeline from the Ocean Recovery Center, indicating dates that the suspect was free/out of recovery, and correlating these with the robbery dates in France, England, and New York City (answer to Math Problem #3)
Your police report must be at least two paragraphs long, with each paragraph containing three to five sentences.

You will turn in the Police Report along with your math sheet.

Answer:

Claire's Police Report

This police report is in regards to the investigation of a suspect believed to be responsible for seven jewelry robberies across three countries. The total value of items stolen is approximately $3.81 million.

The suspect was identified after a label on a duffel bag used in one of the robberies was identified as being from a French designer. This led to further investigation by French and British authorities, who then identified the suspect matching passport stamps. The suspect was then found to have been receiving treatment from Ocean Recovery Center in New York City.

A timeline of the suspect’s stay at Ocean Recovery Center was created to compare with the dates of the robberies. It was discovered that the suspect was not in the care facility during the dates of the robberies in France, England, and New York City. This indicates that the suspect was likely the one responsible for the heists.

Further investigation is necessary to bring the suspect to justice and to recover the stolen items. Therefore, a warrant is requested for the suspect’s arrest and for a search of the suspect’s home for any stolen items.
