a third party who is not part of an original contract but who is transferred a duty to perform set forth in the original contract is called an g

Answers

Answer 1

A third party who is not part of an original contract but who is transferred a duty to perform set forth in the original contract is called a Delegatee.

Delegation in contract law and legal principles refers to the act of assigning another person the duty of executing out the performance specified in a contract. Three parties are involved in this act: the delegator, the delegatee, and the obligee. The delegator assumed the duty to perform under the contract; the delegatee takes on the responsibility of doing so; and the obligee is the one to whom this action is owed. If the delegatee doesn't perform up to par, the obligee can choose to treat this as a breach of the initial contract by the delegator or he can claim third-party beneficiary status and pursue all remedies available to third-party beneficiaries under the agreement between delegator and the delegatee. If there was no regard for the delegation, the delegator would still be responsible for any failure to perform, but the delegatee would have no further obligations.

What do you think of my opinion of gadgets used by the police? Explain your answer!

Vehicle Mounted GPS Launcher
The police pursuits, in my opinion, is just something that is very dangerous, not just for the police officers responding or for the offender but is also very dangerous for the community around, for the kids crossing the streets, the joggers running down the avenue, the vehicles stopped at the traffic light, everyone is at risk. When the pursuit starts, the offender's intent is to run away from the police no matter what. Don't tell me that you never watched on the television how the police pursuits ended up like. Most of the time, the pursuits end up in big accidents causing harm to innocent people that were just in the wrong place at the wrong time.

Currently, the police patrol vehicles are equipped with technology that can in fact support them during pursuits like license plate readers, radio communication systems, and GPS devices. The new vehicle-mounted GPS launcher showed in the video could be something that can make a difference in the future of pursuits. The police officers would be able to launch the tag (GPS tracker) from inside or outside of the patrol vehicle and once the tag is attached to the vehicle, it will transmit a constant GPS signal to the receiving device without compromising the officer and the community safety. This will allow the responding agency to abort the pursuit and let the technology do its job and instead of chasing the vehicle, the law enforcement agency can send the police vehicles to the location of the vehicle once the vehicle gets to a complete stop.

This Technology can be very promising but I can see situations where the effectiveness can be compromised, for example, motorcycles, how you will be able to launch the device and attach it to such a small target efficiently? It can be situations that the technology can't be used as planned but, in my opinion, the combination between technology and the existing law enforcement resources, like air units, undercover patrols, can be the perfect combination and together come up with the best and safest plan to avoid put the officers and the community at risk.

Joe, 17 year old teen, dented someone's parked car on accident. He sees cameras on the owners car and possible house and out of gulit left a note with his name and number on it apologizing. The owner of the car finally called and was nice about the situation but wants to discuss how it should be fixed. Joe discussed this with his parents next. They were furious, saying that it was a bad idea and that he should've driven off and left nothing. They don't think they can afford the dent as they don’t have collision insurance. His parents said to never contact the owner of the car again. Joe, not knowing this parents didn't have that type of insurance nor not knowing what to do, he just sits in frustration and confusion.

What should he do?

What should his parents do?

How could this situation in general be solved?

What would happen if Joe didn't try to contact the owner of the car ever again?

(PLEASE ANSWER IN FULL DETAIL)

Answers

Answer:

Joe did the right thing by leaving a note with his name and number on it to take responsibility for the accident. It shows maturity and responsibility, and it is the ethical thing to do. Even though his parents may have been angry about the situation, leaving the scene of the accident without taking responsibility could have resulted in legal consequences and could have caused more problems in the future.

In this situation, Joe should communicate with the car owner and discuss how the dent can be fixed. He can offer to pay for the damages out of his own pocket, or suggest getting a few quotes from different body shops to compare prices. If the owner agrees to accept payment from Joe, he should get a written agreement or receipt of payment to avoid any legal disputes in the future.

Joe's parents should support him in taking responsibility for his actions and help him find a solution to the problem. They can work together with Joe to find a solution that works for everyone involved, and help him negotiate with the car owner to reach a fair resolution.

In general, situations like this can be solved through open communication and taking responsibility for one's actions. By communicating honestly and openly with the other party involved, it is often possible to find a solution that works for everyone.

If Joe didn't try to contact the owner of the car ever again, it could result in legal consequences. Leaving the scene of an accident without taking responsibility is a serious offense, and could result in criminal charges or a civil lawsuit. It is always best to take responsibility for one's actions and try to find a solution to the problem.

20. The difference between law and regulation is that A. regulation is created by Congress B. regulation isn't created by Congress C. law is created by a non-government agency D. Iaw is associated with penalties

Answers

The difference between law and regulation is that regulation isn't created by Congress. So the correct option is B.

Laws, also known as statutes, are created by legislative bodies such as Congress. They are the formal rules enacted by a government that apply to individuals and entities within a jurisdiction. Laws are established through the legislative process and carry the force of the government's authority. They address fundamental legal principles, rights, obligations, and prohibitions.

On the other hand, regulations are created by administrative agencies or executive branches of government. They are derived from the authority granted to these agencies by the laws passed by Congress or other legislative bodies. Regulations provide specific details, guidelines, and procedures for implementing and enforcing the laws. They are more focused and specific than laws and often deal with technical or operational aspects within a specific domain or industry.

While laws are associated with penalties for non-compliance, the option D ("law is associated with penalties") does not capture the complete difference between law and regulation, as regulations can also be associated with penalties for non-compliance. Therefore, option D alone does not sufficiently differentiate between law and regulation.

current issues with the 2nd amendment

Answers

Answer:

The Second Amendment to the United States Constitution guarantees the right of citizens to bear arms. However, the interpretation and application of the Second Amendment have been a subject of debate and controversy in recent years. Here are some current issues related to the Second Amendment:

Gun Control: There have been numerous mass shootings in the United States, and gun control advocates argue that stricter gun laws are necessary to reduce gun violence. However, Second Amendment supporters argue that any infringement on the right to bear arms is a violation of the Constitution.

Access to Guns: There are concerns that some individuals who should not have access to guns, such as those with a history of violence or mental illness, are able to obtain them. This has led to calls for stricter background checks and other measures to prevent dangerous individuals from acquiring guns.

Open Carry and Concealed Carry: Some states allow individuals to openly carry guns in public, while others allow individuals to carry concealed weapons. This has led to debates about whether these practices make society safer or put people at risk.

Stand Your Ground Laws: Some states have Stand Your Ground laws, which allow individuals to use lethal force in self-defense without first attempting to retreat. These laws have been controversial, with critics arguing that they can lead to unnecessary violence and discrimination.

Overall, the Second Amendment continues to be a divisive issue in the United States, with strong opinions on both sides of the debate.

In state court, a ballerina brought suit against a non-diverse manufacturer of an over-the-counter drug that the ballerina ingested as directed on the packaging. The ballerina claims that, as a result of the drug, she suffered serious vision impairment. The ballerina asserted state law product liability claims and claims for improper labeling of the drug in violation of state law requirements. In its defense, the manufacturer asserts that the ballerina's improper labeling claim is preempted by federal law, and that the manufacturer complied with the federal law requirements regarding the labeling of the drug. The manufacturer also filed a timely notice of removal with the local federal district court. The ballerina then moved to remand the case back to state court and asserts that the federal court lacks subject-matter jurisdiction.
Should the court grant the ballerina's motion to remand the case back to state court?

Answers

The court should deny the ballerina's motion to remand the case back to state court and uphold the removal and retain subject-matter jurisdiction over the case.

The manufacturer's removal of the case to federal court was appropriate because the federal court has subject-matter jurisdiction over the case. The manufacturer raised a federal defense based on preemption, asserting that the ballerina's improper labeling claim is preempted by federal law.

This defense presents a federal question, which gives rise to federal jurisdiction. The fact that the manufacturer complied with federal law requirements regarding drug labeling further supports the federal court's jurisdiction. The dispute revolves around the interpretation and application of federal law, making it appropriate for resolution in federal court.
